Licensing regulations

In October 2006 the Parliament of Victoria passed the Conveyancers Act 2006. When the act comes into operation it will establish a new system of regulation and licensing for non-lawyer Conveyancers in Victoria. Under the Act, a person will not be permitted to carry on a conveyancing business in Victoria without a conveyancer’s licence from the Business Licensing Authority or unless the person is an Australian Legal Practitioner for the purposes of Victoria’s Legal Profession Act 2004. To be eligible for a licence, a Conveyancer must have obtained 12 months work experience and have completed educational qualifications set out in the regulations. Licensing requirements Once the act comes into operation, non-lawyer conveyancers will only be permitted to carry on a conveyancing business in Victoria if they have a conveyancers licence from the Business Licensing Authority.

The Diploma of Conveyancing FNS50411 is the new minimum requirement to practice.

4 industry core units, plus
6 sectoral core units, plus
2 elective units.

FNSICIND401B Apply principles of professional practice to work in the financial services industry

FNSCONV501B Take instructions in relation to a transaction
FNSCONV502B Prepare and/or analyse and execute documents
FNSCONV503B Establish, manage and administer trust accounts
FNSCONV504B Finalise conveyancing transactions
FNSICORG510B Manage own professional development
FNSICCUS501B Develop and nurture relationships with clients, other professionals and third party referrers

NOTE: When selecting units from above please note that FNSCONV502B is a prerequisite unit to FNSCONV504B
